1 Preamble :
The <strong> Riad La Porte du Bouregreg </strong> is operated by the <strong> company Ô Saveurs de la Médina </strong>, SARL under Moroccan law with a capital of 20,000 DHS, having its head office at 6 rue Abdellah Bensaid , Salé Maroc, registered in the Moroccan Trade and Companies Register under number 28117.
The company Ô Saveurs de la Médina offers its customers the possibility of reserving hotel rooms and associated services on its website www.riadlaportedubouregreg.com (hereinafter the “Site”, by e-mail at contact_riad @ osaveurs-medina.com, by phone at number +212 611 34 35 50 or via various reservation websites (eg booking.com) Seminar rooms can only be reserved by phone, post or e-mail. These general conditions of sale of Riad La Porte du Bouregreg (hereinafter the “GTC”) define the rights and obligations of the parties within the framework of the reservation of rooms within the Hotel and other services offered by the company Ô Saveurs de la Médina. Any reservation assumes the Customer’s acceptance without restriction or reservation of the GTC, either on the website at the time of booking by checking the box provided for this purpose, or on paper at the time of registration ( “Che ck-in ”). The Customer declares to have obtained from the company Ô Saveurs de la Médina all the necessary information on the Site and to have full legal capacity allowing him to commit himself under the T & Cs. The Customer has the option of saving and editing the T & Cs from the Site using the standard features of his browser or computer or requesting a hard copy during Check-in. The Site mentions the following information:
- The essential characteristics of the accommodation offered.
- Additional services offered.
- Prices and terms of payment.
- The GTC.
2 Definitions :
In the remainder of the present, the terms below will have the following meaning:
- “Acknowledgment of receipt”: Electronic mail sent by Riad La Porte du Bouregreg to the Customer recapitulating the reservation made by the Customer and confirming its receipt.
- “Reservation confirmation”: Dematerialized document which summarizes the characteristics of the services reserved by the Customer, and by which he enters his bank card number as part of a prepayment. The reservation prepayment by the Customer has the effect of contractually binding this Customer as well as the company Ô Saveurs de la Médina.
- “Client”: Natural or legal person acting for his personal or professional needs.
- “Consumer”: Any natural person who acts for purposes that do not fall within the scope of his commercial, industrial, craft or liberal activity
- “Electronic mail”: Any message, in the form of text, voice, sound or image, sent by a public communication network, stored on a server of the network or in the terminal equipment of the recipient, until that the latter collects it.
- “Reservation request”: Request for reservation of hotel rooms made by the Customer by any means.
- “Partners”: Service providers accessible from the Site or the Mobile Services, and in particular, airport shuttles and beauty care professionals
- “Online reservation”: Reservation of hotel rooms through the dematerialized reservation system on the Site.
- “Service”: Reservation of hotel rooms, the characteristics of which are presented on the Site as well as the associated services.
- “Site”: Electronic service operated by the company Ô Saveurs de la Médina on the Internet and accessible at the address www.riadlaportedubouregreg.com
3 Reservations :
- The Customer acknowledges having read the nature, destination and reservation methods of the services available on the Site and having requested and obtained the necessary and / or additional information to make their reservation in full knowledge of the facts.
- The Customer may book, on the Site, individually, and for his personal needs, an Unlimited number of rooms, the only limit being the maximum number of beds. For reservations for business groups or tourists, meetings, seminars, etc., it is necessary to make contact by phone or email.
- The Customer is solely responsible for his choice of services and their suitability for his needs, so that the responsibility of the company Ô Saveurs de la Médina cannot be sought in this regard.
- The reservation is deemed to have been made as soon as it is confirmed by Ô Saveurs de la Médina or when prepayment is made online by credit card or when the deposit is actually paid for group reservations. (see article 4.)
- The Customer agrees, prior to any reservation, to complete the information requested on the voucher or during the reservation request. He also agrees, where applicable, to communicate the number of any Promo Code that he intends to use to pay for all or part of the booked stay.
- The Riad la Porte du Bouregreg Site acknowledges receipt of the Customer’s reservation following payment by credit card, by sending an email without delay.
In the case of online reservation, the acknowledgment of receipt of the reservation by e-mail summarizes the services reserved, the prices, the conditions of sale relating to the selected rate accepted by the Customer, the date of reservation made.
4 Validation by prepayment:
Except for specific cases of groups, all reservations are subject to a prepayment of the entire amount of the reservation
This prepayment has the effect of validating the reservation and contractually binding the Customer and the company Ô Saveurs de la Médina in relation to these General Conditions of Sale.
Other bookings – Group bookings of more than 10 people are only accepted against payment of a deposit of 30% of the amount of the stay.
All prepayments (deposit or full) can be made:
- Either by direct debit from a bank card: VISA, MASTERCARD via the Site
Or by bank transfer
Or by Paypal
5 Cancellation or modification by the Client
- Except in specific cases (force majeure, etc.) negotiated between the Client and the management of the Riad la Porte du Bouregreg, all reservations canceled by the Client will be processed as follows:
Cancellation conditions for group and other reservations: (D = day of arrival)
- Cancellation D – 30 and +: reimbursement of 90% of the prepayment
- Cancellation between D – 29 and D – 7: reimbursement of 50% of the prepayment
- Cancellation between D – 7 and D: no refund of the prepayment
- No show at the hotel (No Show): no refund of the prepayment
- Where possible, any cancellation must be confirmed by mail, fax or email.
- For any shortened stay or delayed arrival, the full cost of the planned stay in accordance with the reservation will be due.
6 Hotel stay
- All reservations are personal and cannot under any circumstances be transferred to a third party, whether free of charge or against payment.
- The maximum number of people per room is two (2) for a Standard room and four (4) for a Suite. It is possible to add a cot at the rate of 50 DHS per night up to 3 years.
- The rooms are available from 3 p.m. on the day of arrival and must be vacated by noon on the day of departure, regardless of the time of arrival or departure, of the means of transport used, unless expressly provided for. contrary. Otherwise, an additional night may be billed. Depending on availability, the room may be kept until 3 p.m. on the day of departure, subject to payment of a supplement of 20 euros.
- In accordance with Moroccan law, the Customer will be asked, on arrival at the Hotel, to complete a police form. To do this, he will be asked to present an identification document. The company Ô Saveurs de la Médina will keep a copy of the identity document.
- Animals are not normally accepted in the Hotel except in very special cases. Customers wishing to bring an animal into the Hotel during their stay must notify us at least 2 days before their arrival in order to inform us of this wish and provide us with details of the animal. The Customer will present a vaccination certificate for his animal upon arrival. In any case, Ô Saveurs de la Médina reserves the right to refuse any animal that it considers to be dangerous or whose behavior would disturb the peace and comfort of Hotel Guests.
Price: 50 DHS per night and per animal.
- The Customer accepts and agrees to use the room with due diligence. Also any behavior contrary to good morals and public order will cause the company Ô Saveurs de la Médina to ask the Customer to leave the establishment without any refund if a payment has already been made. In the event that no payment has yet been made, the Customer must pay the price for the nights spent before leaving the establishment.
- The Hotel offers free Wi-Fi access allowing Customers to connect to the Internet. The Customer undertakes that the computer resources made available to him by the Hotel will not be used in any way for the purposes of reproduction, representation, making available or communication to the public of works or objects. protected by copyright or by a neighboring right, such as texts, images, photographs, musical works, audiovisual works, software and video games, without the authorization of the holders of the rights provided for in books I and II of the property intellectual property when this authorization is required. If the Client does not comply with the aforementioned obligations, he would risk being accused of an offense of counterfeiting punishable by a fine of DHS 300,000 and three years’ imprisonment. The Customer is also required to comply with the security policy of the Hotel’s internet service provider, including the rules for using the means of securing implemented in order to prevent the illicit use of resources. and to refrain from any act that undermines the effectiveness of these means.
- The Hotel is accessible by car but does not have its own parking spaces. However, the Customer may park his vehicle in the rue du Riad or in an adjacent street and secure the services of a “guard” who for 20 DHS / night will watch him. These “guards” are easily spotted with their yellow vests and will find a place for you to park. The Customer will pay the custodian directly for the service rendered.
- Smoking is prohibited in the entire Riad La Porte du Bouregreg establishment, except on the roof terrace. On this same terrace, we ask Smoking Customers to respect non-smokers by asking them for permission if they are seated nearby.
- From 11 p.m., in order to respect everyone’s sleep, we ask to stop noise pollution (too loud TVs in the bedrooms, excessive songs and laughter in the living rooms or on the roof terrace, etc.)
- Any room change request more than one hour after Check-in and key collection will be made under the following conditions:
- A new room will be offered depending on availability. This new room will be billed to the Customer at the price at its normal price. A cleaning allowance of 100 DHS will be invoiced to the Customer for the first room
7 Prices
- The prices relating to the reservation of services are indicated before and during the reservation.
- The prices indicated are per room and per night, for the number of person (s) and the dates selected according to the rates in effect during the period of stay.
- The prices are confirmed to the Customer in Moroccan Dirham.
- All reservations, regardless of their origin, are payable in Moroccan Dirhams or euros.
- Tourist tax and additional services (cot, half board, full board, Hammam, cooking lessons, beauty treatments, etc.) if these are not included in the reservation and the prepayment, are therefore to be paid directly on site at the hotel.
- The prices take into account the VAT applicable on the day of the order and any change in the rate applicable to the VAT will be automatically reflected in the prices indicated on the date of invoicing.
- Any modification or introduction of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated on the date of invoicing.
- The company Ô Saveurs de la Médina, will indicate the total amount of the reserved stay when confirming the Customer’s reservation. Services ordered and consumed during the stay will not be included; these will be payable on site.
- Certain promotional offers that may be available on the internet are sold exclusively on the internet and under no circumstances at the hotel reception.
8 Payment
- In the event of a reservation via the www.riadlaportedubouregreg.com Site, the Customer will validate their reservation via a secure online payment using their credit card for the full amount of their reservation. The amount to be paid in this case will depend on the type of rate chosen by the Customer, the room or suite selected, the period and length of stay and finally the number of days between the date of reservation and the date of arrival
- In the case of the initial payment of a deposit by the Customer to secure his reservation (example: group of more than 10 people) he will be asked:
- To pay a deposit of 50% of the total amount on the date of the reservation
- In the event of a reservation via a partner platform (eg: Booking.com), the Customer will comply with the reservation and payment terms offered by the said platform. In the event that the Customer has not paid the partner platform directly at the time of his reservation:
- The management of the riad reserves the right to test the validity of the Customer’s credit card before his arrival by making a debit that will not exceed 50% of the total amount of the reservation.
- Any missing equipment (for example: bottle opener, towels, bath towel, bathrobe, etc.) will be invoiced to the Customer and debited according to the terms in the paragraph below
- The Customer expressly and irrevocably authorizes the company Ô Saveurs de la Médina to debit the bank card whose references have been communicated to it by the Customer in order to pay all sums due for the stay, including the cost of repairs and repair of any degradation, breakage, theft, etc… attributable to the Customer and / or to the persons accompanying him.
9 Responsibility
- The photographs presented on the Site / Brochures / Displays are not contractual. Although every effort is made to ensure that the photographs, graphic representations and texts reproduced to illustrate the hotels presented give as exact an overview as possible of the accommodation services offered, variations may occur, in particular due to the change of furniture. or possible renovations.
- Hypertext links may refer to other sites than the site of the company Ô Saveurs de la Médina, which disclaims all liability for the content of these sites and the services offered.
- Any reservation or payment that is irregular, inoperative, incomplete or fraudulent for a reason attributable to the Customer will result in the cancellation of the order at the Customer’s expense, without prejudice to any civil or criminal action against the latter.
10 Respect for private life.
- The Customer is informed, on each of the online personal data collection forms, of the mandatory or optional nature of the responses by the presence of an asterisk. Optional information requests are intended to better understand and improve the services offered to it.
- In the absence of information identified as mandatory, the Company may not be able to register a reservation and manage the latter’s complaints.
- The information processed is intended for the company Ô Saveurs de la Médina, its partners, its service providers, and in particular online payment providers, to which the Customer authorizes the communication of his personal data.
- As part of pre-contractual measures with a view to the reservation or the execution of the reservation contract, they may, each as far as they are concerned, be recipients of identity data, personal and professional life data, information of an economic and financial nature, for the purposes in particular of hotel reservations and management of complaints, but for exclusively non-commercial purposes, which the Customer declares to have read and accepted.
- The Customer has the right to access, modify, rectify and delete data concerning him. To exercise it, all you have to do is contact Ô Saveurs de la Médina, to request it at the postal and electronic addresses mentioned at the top of these T & Cs.
11 Convention of proof
- Entering or providing the required banking information, as well as acceptance of these general conditions and the reservation voucher or request, constitutes an electronic signature which has, between the parties, the same value as a handwritten signature.
- The computerized registers kept in the computer systems of the company Ô Saveurs de la Médina will be kept under reasonable security conditions and considered as proof of communications, orders and payments between the parties.
- The Customer is informed that his IP address is recorded at the time of booking.
12 Dislodgement
- In the event of non-availability of the Hotel, of a technical problem in the Hotel, of work or for any other reason, except in the event of force majeure, the latter will make its best efforts to have the Participants fully or partially accommodated in a another hotel for services of the same nature and of the same quality.
- Any additional cost of the room, transport between the two hotels and a telephone call will be the responsibility of Ô Saveurs de la Médina, which cannot be sought in payment of any additional compensation.
13 Force majeure
- Force majeure means any event outside the parties that is both unpredictable and insurmountable which prevents the company Ô Saveurs de la Médina from fulfilling all or part of the obligations provided for in the contract (examples: fire, flood, damage to water, room ransacked by the previous client….).
- The company Ô Saveurs de la Médina cannot be held responsible towards the Customer in the event of non-performance of its obligations resulting from an event of force majeure. It is expressly agreed that force majeure suspends, for the company Ô Saveurs de la Médina, the performance of its obligations and that each party bears the cost of the resulting costs.
14 Settlement of disputes
- The Customer is informed by the company Ô Saveurs de la Médina of the possibility of having recourse, in the event of a dispute relating to these general conditions, to a conventional mediation procedure or to any other alternative mode of dispute settlement.
- Complaints relating to the non-performance or improper performance of hotel services must, under penalty of foreclosure, be brought to the attention of the company Ô Saveurs de la Médina in writing within eight days after the date of departure from the hotel. directly from the hotel or to the Customer Service contact details indicated at the top of these T & Cs.
- After entering customer service or the hotel and attempting to resolve the dispute amicably, in the absence of an amicable settlement within 60 days from the date of referral, the customer may refer the matter to the Mediator of Tourism and Trip
15 Applicable law – Language – Competent court
- These General Conditions of Sale are governed by Moroccan law. Only the French language version of these General Conditions is valid. In the event of a persistent dispute, exclusive jurisdiction is given to the courts within the jurisdiction of the Court of Rabat, including in summary proceedings.
16 Entirety
- These T & Cs and the reservation voucher or request express all the obligations of the parties.
- No general or specific condition communicated by the Customer can be incorporated into these general conditions.
- The documents forming the contractual commitments between the parties are, in decreasing order of priority, the reservation voucher or request (including the special conditions of the reserved rate) and these GTC.
- In the event of a contradiction between the booking voucher and the GTC, the provisions appearing on the booking voucher will be the only ones applicable for the obligation in question.
17 Evolution / modification of the General Conditions of Sale
- These T & Cs may be modified and / or supplemented at any time by the company Ô Saveurs de la Médina. In this case, the new version of the general conditions of sale will be put online by the company Ô Saveurs de la Médina. As soon as it is posted on the internet, the new version of the T & Cs will apply automatically to all Customers.
